Someone used a photo composite I did as stock art on DA. I didn’t originally intend for it to be stock art. I do have one piece in my gallery that is, and I state on it that it is the only piece in my gallery that is, but I am not against the use of other pieces of my art as long as the person asks me before using them.
This piece is very near/dear to me and it stands on it’s own as a piece. I’m really not sure how I feel about this. Should I ask for it to be taken down, or allow it to be used?
Had he asked, I probably would have said no. However, he did leave a comment telling me that he used it.
There was also no way to watermark it, since it was a very dark object on a white background.
You should just tell him to please take it down if it bothers you.

Tell him to take it down, and from now on watermark all your work on DA.
It’s the best way to protect your stuff.

This is your property. If someone uses it without permission it theft, plain and simple. Permission does not necessarily involve a fee. You may simply require the user to clearly state in the place where it is used that it is your work and it is used by permission and may not be further reproduced by others. He or she may NOT allow it to appear to be a copyright-free stock image.
I have asked permission to use others’ works in various web pages on the web and it has always generously been given in return for a credit such as I described. Of course there are times when images really are in the public domain, no authorship is claimed or a source can not be found. (See links below)
Refusing to do so or refusing to remove your image will be considered a breach of intellectual copyright law in most jurisdictions.
Please note I am not an intellectual property lawyer and so my opinions are from general reading and experience and not from qualifications — but as a writer and photographer, they are of concern to me as they are to you.
